General Terms and Conditions of Sale

Article 1 – Purpose and Scope
These General Terms and Conditions of Sale (hereinafter "GTCS") govern all product sales made by Bowvibe SASU (hereinafter "the Seller"), with a capital of 1 euro, registered with the Paris Trade and Companies Register under number 101 990 760, whose registered office is located at 60 rue François 1er, 75008 Paris, France, via the website bowvibe.com (hereinafter "the Site").
Any order placed on the Site implies full and unconditional acceptance of these GTCS by the customer (hereinafter "the Customer"). These GTCS prevail over any other document issued by the Customer.
The Seller reserves the right to modify these GTCS at any time. The applicable GTCS are those in effect on the date
of the order.
Article 2 – Products
The products offered for sale are those described on the Site at the time of the Customer’s consultation. Photographs and product descriptions are provided for informational purposes only and are not contractually binding.
The Seller commits to providing products compliant with current European regulations, especially regarding cosmetics (EC Regulation No. 1223/2009).
The Seller reserves the right to remove any product from the Site at any time and to modify the information displayed there.
Article 3 – Prices
Product prices are shown in euros, all taxes included (TTC), excluding delivery fees. Delivery fees are specified before order confirmation.
The Seller reserves the right to change prices at any time. Products are billed at the price in effect at the time the order is confirmed.
Article 4 – Order
4.1 – Ordering Process
The Customer selects the desired products, adds them to the cart, provides the necessary delivery and payment information, then confirms the order after accepting these GTCS.
Order validation constitutes acceptance of the prices, product descriptions, and these General Terms and Conditions of Sale (GTCS).
4.2 – Order Confirmation
A confirmation email summarizing the order is sent to the Customer at the provided email address. This email does not constitute acceptance of the order by the Seller, who reserves the right to refuse any order for legitimate reasons (incorrect information, payment issues, abnormal order, etc.).
4.3 – Availability
Product offers are valid while stocks last. In case of product unavailability after order placement, the Customer will be informed by email and may choose between a replacement product, a credit, or a full refund.
Article 5 – Payment
5.1 – Payment methods
Payment is made online at the time of order confirmation. Accepted payment methods are indicated on the Site (bank card, and any other method available via the payment platform).
5.2 – Payment security
Transactions are secured by the payment provider Shopify Payments (Stripe). The Seller never has access to the Customer’s full bank details. Payment is processed according to PCI-DSS standards.
5.3 – Payment default
In case of payment refusal or payment default, the Seller reserves the right to suspend or cancel the order.
Article 6 – Delivery
6.1 – Delivery areas
The Seller delivers to the geographic areas indicated on the Site. The Customer is responsible for the accuracy of the delivery information provided.
6.2 – Delivery times
Delivery times are given as an indication and vary depending on the destination. They start from the confirmation of shipment. An average delay of 7 to 9 business days is to be expected depending on the destination.
A delivery delay cannot lead to order cancellation or damages, except if the delay exceeds 30 days from the order date, in accordance with article L.216-2 of the Consumer Code.
6.3 – Delivery fees
Delivery fees are communicated to the Customer before order confirmation. If applicable, delivery may be free according to the conditions indicated on the Site.
6.4 – Receipt and anomalies
The Customer is required to check the condition of the package upon receipt. In case of a damaged package or missing product, the Customer must report it to the Seller within 48 hours of receipt, by email to contact@bowvibe.com, accompanied by photos of the package and the product.
6.5 – Lost packages
In case of a lost package, the Seller commits, after verification with the carrier, to resend the product or refund the order.
Article 7 – Right of withdrawal
In accordance with articles L.221-18 and following of the Consumer Code, the Customer has a period of 14 calendar days from the receipt of the product to exercise their right of withdrawal, without having to justify a reason or pay a penalty.
7.1 – Exercising the right of withdrawal
The Customer must notify their decision to withdraw by a clear statement sent to the Seller by email at contact@bowvibe.com, before the expiration of the 14-day period.
7.2 – Exceptions to the right of withdrawal
In accordance with article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the following products:
∙ Hygiene or body care products unsealed after delivery (creams, gels, soaps, etc.) for health protection reasons.
∙ Products that, by their nature, cannot be reshipped or are likely to deteriorate quickly.
7.3 – Product returns
Products must be returned in their original packaging, complete, unused, and unopened. Return costs are the responsibility of the Customer.
7.4 – Refund
In case of accepted return, the refund will be made within 14 days following receipt of the returned product, via the same payment method used during the order. Initial delivery costs are refunded only if the entire order is returned.
Article 8 – Legal guarantees
The Customer is fully entitled to the legal guarantees provided by the Consumer Code:
8.1 – Conformity warranty (articles L.217-1 and following)
The Seller is required to deliver a product that complies with the contract. In case of a conformity defect found within 2 years from delivery, the Customer may obtain repair, replacement of the product, or failing that, a price reduction or contract termination.
8.2 – Warranty for hidden defects (articles 1641 and following of the Civil Code)
The Customer may take action for hidden defects within 2 years from the discovery of the defect and obtain a refund of the price or a reduction of it.
Article 9 – Liability
The Seller cannot be held responsible in case of:
∙ Non-compliance with the legislation of the delivery country, which the Customer is responsible for verifying.
∙ Improper use or non-compliant use of the products.
∙ Individual reactions related to intolerance or allergy to one of the product's components. It is recommended that the Customer consult the list of ingredients (INCI) and perform a preliminary test before any use.
∙ Force majeure within the meaning of Article 1218 of the Civil Code.
The Seller’s liability is limited to the amount of the order.
Article 10 – Personal data
The Seller collects and processes the Customer’s personal data as part of order execution, in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and the Data Protection Act.
Detailed information regarding the processing of personal data is provided in the Privacy Policy accessible on the Site.
The Customer has the right to access, rectify, delete, port, and object to their personal data, which they can exercise by email at contact@bowvibe.com.
Article 11 – Intellectual property
All elements of the Site (texts, images, logos, videos, graphics, trademarks) are the exclusive property of the Seller or its partners and are protected by intellectual property law. Any reproduction, representation, or exploitation, even partial, without prior written authorization from the Seller, is prohibited.

The Seller undertakes to respond within a reasonable time.
Article 13 – Mediation
In accordance with Articles L.612-1 and following of the Consumer Code, in case of a dispute not resolved after prior complaint to the Seller, the Customer may use the free consumer mediation service. The competent mediator will be communicated to the Customer upon simple request sent to contact@bowvibe.com.
The Customer may also file a complaint on the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 14 – Applicable law and competent jurisdiction
These Terms and Conditions of Sale are subject to French law.
In case of a dispute relating to the interpretation or execution of these Terms and Conditions of Sale, and failing an amicable resolution or mediation, the competent courts of Paris shall have exclusive jurisdiction, subject to the mandatory provisions of the Consumer Code relating to jurisdiction.
